(RHR) Waiver and Release

The undersigned (Participant) acknowledges that (i) Ross Hammock Ranch, Inc. (RHR) is a working Farm and/or Ranch located in the State of Florida and (ii) the activities that Participant (and/or Minors that are with participant) will do at RHR are Agritourism activities as defined under the Florida Agritourism Law stated directly below:

“Under Florida law, an agritourism operator is not liable for injury or death of, or damage or loss to, a participant in an agritourism activity conducted at this agritourism location if such injury, death, damage, or loss results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury, death, damage, or loss. You are assuming the risk of participating in this agritourism activity.”

The undersigned (I) , on behalf of myself, my minor children (Minors) if also at RHR , my heirs, personal representatives, executors, guardians, administrators, successors, and assigns, consistent with the Florida Agritourism law above, hereby voluntarily waive and release any causes of action, suits, debts, claims and demands whatsoever, in law or equity, that I and/or Minors may hereafter have against RHR and/or the owners, employees, and sub-contractors of RHR, resulting from injury, death, or loss of any nature as consequence of RHR providing the opportunity to hunt, fish, conduct photography, camp, hike, lodge, visit, and/or pursue other indoor or outdoor activities on property owned or used by RHR.

I understand that the above described activities, as well as the associated activities of boating, climbing/using tree stands, field transportation, and/or the use of weapons, meet the definition of Agritourism activities and are inherently dangerous activities and that serious injury or death is possible. I understand that it is my responsibility to provide and wear a safety belt at all times when using a tree stand. Before using a tree stand, regardless of who made or placed the tree stand, it is my responsibility to verify its safety, worthiness for use, and/or stability.

I hereby agree not to file any charges, claims, suits, complaints, and/or grievances against or with respect to my, or my minor child’s activities, while on RHR property. I acknowledge that the permission and opportunity to engage in these activities while on RHR property, constitutes good and valuable consideration for the execution of this Waiver and Release.
